These Terms of Service ("Terms") govern your access to and use of ColdMailCalculator (the "Service"). By using the Service, you agree to these Terms. ColdMailCalculator provides cold email outreach forecasting, campaign scoring, ROI estimation, risk/safety analysis, and optimization recommendations through web-based calculators and API access. It does not send emails on your behalf.
2. Eligibility
You must be at least 18 years old to use this Service. By creating an account, you confirm you have the legal authority to enter into a binding agreement. If using on behalf of a business, you represent you have authority to bind that entity.
3. Description of Service
ColdMailCalculator provides forecasting and planning tools including web-based calculators, campaign scoring, ROI estimation, risk analysis, optimization recommendations, and API access. Important: ColdMailCalculator is a forecasting and planning tool only. It does not guarantee deliverability, replies, booked calls, revenue, or compliance outcomes. Users are responsible for following all applicable email, privacy, anti-spam, and data protection laws in their jurisdiction.
4. API Access
Paid plans include API access delivered through your account dashboard or by email after purchase. Developer preview API access is available at /api/get-key/.
API keys are for the account holder only. You must not share your API key publicly, embed it in client-side code, or use it to resell access without written permission. Report compromised keys immediately to support.
5. Account Responsibilities
You are responsible for maintaining account credential confidentiality and for all activity under your account. Notify us immediately of any unauthorized access.
6. Acceptable Use
You agree to use the Service lawfully. You must not use the Service to plan spam campaigns, scrape or overload our infrastructure, submit false inputs, target individuals in violation of privacy laws, or resell API access without permission.
7. Prohibited Uses
- Planning or facilitating phishing, fraud, or deceptive communications
- Submitting third-party personal data without consent
- Circumventing rate limits, usage limits, or access controls
- Uploading malicious code through the API
- Any use that violates applicable laws or regulations
8. Email and Outreach Compliance
ColdMailCalculator does not send emails. Users conducting cold email outreach based on our outputs are solely responsible for complying with applicable laws including CASL, CAN-SPAM, GDPR, and any local privacy or anti-spam regulations. ColdMailCalculator does not guarantee inbox placement, reply rates, or compliance with any law.
9. Credit Pack Billing
Credit packs are prepaid one-time purchases priced in USD. Payments are processed by Stripe. Charges may appear as COLDMAILCALCULATOR. Credits do not expire. When you purchase a credit pack, you pay once and use credits as you run forecasts through the API.
10. Cancellation
Credit packs are paid upfront and do not auto-renew. There is no recurring billing to cancel. If you have remaining credits and no longer need API access, no further action is needed — no future charges will occur. See our Cancellation Policy.
11. Refunds
Because credits are delivered digitally and immediately upon purchase, credit pack purchases are generally non-refundable after access is provided. Billing errors or duplicate charges may be reviewed if reported within 7 days. See our Refund Policy.
12. Intellectual Property
All content, code, and branding on ColdMailCalculator are our intellectual property. You may not reproduce or create derivative works without written permission. You retain ownership of data you submit; by submitting, you grant us a limited license to process it to deliver the Service.
13. Third-Party Services
We use third-party services including Stripe for payments. Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party practices.
14. Disclaimers
The Service is provided "as is" without warranties. We do not warrant the Service will be uninterrupted or error-free, or that any forecast, score, or recommendation will be accurate or produce any particular business result. All outputs are estimates only.
15. Limitation of Liability
To the maximum extent permitted by law, ColdMailCalculator and its owners shall not be liable for indirect, incidental, or consequential damages arising from use of the Service. Our total liability shall not exceed amounts paid by you in the three months preceding the claim.
16. Changes to These Terms
We may update these Terms periodically. We will notify users of material changes by updating the date above or by email. Continued use after changes constitutes acceptance.
